Definitions
The term "Online Sales Contract" means the contract of sale concerning the products / services of the Supplier (as defined herein) stipulated between them and the Customer (as defined below) in the context of a remote sales system via telematic means, organized by the Supplier (hereinafter the "Contract"). The term "Buyer" or "Customer" means the consumer who is the physical person who makes the purchase, as per the present contract, for purposes not related any commercial or professional activity of his own. The term "Supplier" refers to the person who sells the goods covered by this Contract.

The Parties to the Contract and access to the online product purchase service
The assets covered by these general terms and conditions (hereinafter the "Products") are offered for sale by Società Agricola 47 A. D. S.s. with headquarters in via Obbia Bassa, 1 a Trebaseleghe (PD) 35010 and production premises in Roncade (TV) 31056 in Via Treviso Mare 2. VAT no. 03384780262; (hereafter the “Supplier” or “47 Anno Domini).

The buyer (hereinafter also the "Customer") expressly declares to make the purchase for purposes unrelated to any business, commercial, craft or professional activity carried out. Access to the online product purchase service is limited to adults by means of a check mark where the customer declares his age. It is expressly forbidden for the Customer to enter false and / or fictional data in the registration procedure necessary to activate the process of the execution of this Contract and the relative additional communications; the personal data transmitted by the Customer must correspond to their real personal data and not to third parties or invention. It is expressly forbidden to make multiple registrations corresponding to the same person or enter data of third parties. The company reserves the right to prosecute any violation or abuse, in the interest and for the protection of consumers. "47 Anno Domini" declines any responsibility to the customer deriving from the issue of incorrect tax documents due to errors related to data provided by the Customer, since the Customer is solely responsible for the correct insertion of said data.

It is understood that "47 Anno Domini" cannot be held responsible in any case by the Customer and / or third parties for the abusive use of the Password and, in general, the online purchase service through the Website (as defined below) by unauthorized third parties.

Content and conclusion of the Contract
With this contract, "47 Anno Domini" sells to the Purchaser, who purchases at a distance, via electronic means, exclusively the products / services indicated and offered for sale on the website www.47annodomini.it and related sub-domains: www.degustazioni. 47annodomini.it, www.cosmetics.47annodomini.it, www.celebrate.47annodomini.it and others that may be activated (hereinafter the "Website").

The Contract between "47 Anno Domini" and the Customer is concluded exclusively through the Internet by the Customer accessing the address of this Web Site, where, following the procedures indicated in the appropriate registration section, the Customer will later formalize the proposal for the purchase of the Products / Services offered for sale through the Website.

The purchase contract is concluded by order from the customer with the completion and online submission of the purchase order form of the product / service, which will be displayed on the web page of the order summary, printable, and sent by mail, in which will be shown the details of the Customer and the purchase order, the price of the products / services purchased and any shipping costs, the methods and terms of payment and the address where the product will be delivered. When 47 Anno Domini receives the purchase order from the Customer, it will send a confirmation e-mail and / or display a confirmation web page and a summary of the purchase order, printable, in the which will be shown the data entered by the customer on the order form. The Contract is considered perfected and effective between the parties only with the execution of the order and the issue of the related invoice by the company, since the latter has the possibility, up to that moment, to refuse the order. The sales document will be issued by the Supplier in paper form and included in the package containing the ordered Products.

Method of Payment or Refund
“47 Anno Domini” accepts payment for products ordered by means of main credit cards (Mastercard Visa circuits) and by Pay Pal.

Credit card details are managed directly by credit institutions and / or financial companies, specialized in online payment management. The information is encrypted using cryptographic systems that prevent use by third parties and is sent directly to the bank. In the event that problems and / or irregularities are detected in the electronic process for the purchase of Products by credit card, "47 Anno Domini" may carry out checks (such as but not limited to: verification of the ownership of the credit card and / or checks regarding a possible misuse of the card, etc. ..). At the end of this verification, in the event that irregularities are detected, "47 Anno Domini" will not proceed with the order.

In the event that no irregularities are found during the electronic process for the purchase of the Products / Services, "47 Anno Domini" will follow up the order and carry out the delivery of the Products, provided that there are no further impediments.

If the conditions are met, any refund to the customer will be made: - by cancellation of the credit card payment within 14 days from the date on which "47 Anno Domini" has become aware of the cause that generates the right to reimbursement;

Times and methods of delivery of the Products
"47 Anno Domini" will deliver the ordered products by means of contracted couriers. Delivery times may vary but are as follows: in Italy from 1 to 7 working days; to the European Union countries from 3 to 14 working days and for countries outside the European Union, from 5 to 30 working days, from the execution of the order and receipt of payment, within which time the invoice will be issued by the Supplier the order accepted, In the event that the Supplier is not able to deliver the ordered Products within this period, notice will be given promptly by e-mail and / or telephone communication to the Customer, with indication of the period within which the order will be completed. It is understood that delivery times may vary depending on the destination country and other factors that are beyond the control of "47 Anno Domini".

Delivery Costs and Product Shipment
"47 Anno Domini" ships with the DDP (Delivery Duty Paid) formula in the CE countries, therefore in these destinations the ordered Products will arrive directly at the delivery location indicated by the Customer in the order request, without the latter having to pay any further sum beyond that paid at the time of the order. For all other countries the DDU (Delivery Duty Unpaid) formula is used, therefore the courier could present to the Customer at the time of delivery of the Products, a separate invoice requesting payment of the duties and taxes requested by the local authorities where applicable. Goods insurance and liability arising from transport
“47 Anno Domini” assicura i Prodotti contro il furto e danno accidentale dal momento della consegna al corriere fino al momento in cui giungono a destinazione presso il Cliente. Resta in ogni caso inteso che il Fornitore non risponde dell’eventuale ritardo nell’evasione dell’ordine o nella consegna dei prodotti dovuti al trasportatore e di eventuali danni cagionati alla merce durante il trasporto. “47 Anno Domini” provvederà ad affidare al vettore merce perfettamente integra e corrispondente all’ordine richiesto.

Prices of Products / Services
All sales prices of the Products / Services displayed and indicated on the Website are expressed in euros (€) and constitute an offer to the public pursuant to art. 1336 of the Civil Code, are inclusive of VAT and any other tax with regard to delivery within the territory of an EC country. For deliveries to countries outside the EC, as specified in point 6), the courier may request additional amounts for local taxes and duties. Product Availability
"47 Anno Domini" ensures the processing and fulfillment of purchase orders for Products / Services through the telematic system used. If a purchase order exceeds the quantity of the existing Products in the warehouse, the Supplier, through e-mail and / or telephone communication, will inform the Customer if the Product is no longer available or of the waiting times for the Product chosen, asking, in the latter case, if the customer intends to confirm the order or not. The Supplier confirms the registration of the purchase order as soon as possible by sending the Customer a confirmation by e-mail, which does not produce any legal obligation, since it is a simple summary of the order.

Supplier's liability limitation
"47 Anno Domini" assumes no responsibility in the event that it fails to execute the order within the time specified in the Contract for disservices due to unforeseeable circumstances or force majeure. The Supplier can not be held responsible by the Customer, except in cases of willful misconduct or gross negligence, for disservices or malfunctions related to the use of the Website, independent of the will of the Supplier of its collaborators and / or its sub-suppliers, which are beyond reasonable predictability and to which cannot be remedied without greater precautions than those of average diligence. In any case any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance, even partial, of an order by "47 A.D". The Supplier assumes no responsibility for any fraudulent and illegal use that may be made by third parties, of the credit cards used for payment of the Products purchased, if it proves to have adopted all the ordinary possible precautions of the moment and based on standard diligence.

Liability for defects in the Products, proof of damage and compensable damages
"47 Anno Domini" cannot be held responsible for any direct and / or indirect, contractual and / or non-contractual damage suffered by the Customer arising from defects and / or flaws in the Product if the defect and / or flaw is due to conformity of the Product, to an imperative juridical rule or to a binding provision, or if the state of scientific and technical knowledge at the moment in which the producer has placed the Product on the market, did not yet allow the Product to be considered as defective and / or flawed. It remains that no compensation will be due if the Customer is aware of the defect and / or flaw in the Product and the danger that derives from it and nevertheless has voluntarily exposed itself to said danger. In any case, the Customer has the burden of proving the defect and / or the flaw in the Product / Service purchased, the damage and the causal connection between the defect and the damage suffered. The Customer is aware of the fact that the Products / Services ordered are described and photo-reproduced on the Website, therefore, will tolerate the normal differences and colour tonality variances of the Products that will be delivered with respect to the Products viewed on the Website.

Guarantees of Assistance and Customer Support

In the event that a defect is found in the Product purchased, the Customer can directly contact the company through the use of a telephone number and an e-mail address, indicated on the Website. The company will also provide the assistance necessary for the solution of problems related to any complaints by the customer and all assistance during the online purchase operations of the Products. we remind you that the colour of the photos of the products seen on the monitor, may differ from the colour of the product itself.

Customer Obligations
Once the online purchase procedure is completed, the Customer undertakes to provide for the printing and preservation of the present general sales conditions as well as the specifications of the Product / Service object of the purchase. Right of Withdrawal
The Customer has the right to withdraw from the Contract, pursuant to Legislative Decree 21/02/2014 n. 21 within the term of 14 (fourteen) days, starting from the day of sending the purchase order for the Products. In the event that the Customer makes use of the right of withdrawal, the Supplier must be notified by registered email at 47annodomini@pec.it In any case, in order to be availed of the right to refund the price of the Product, the Customer must return the product intact in its packaging and, in any case, not used or tampered with.The Customer acknowledges that the right of withdrawal can not be exercised in relation to Products ordered by the Customer that have been customized. The only expenses payable by the purchaser for the exercise of the right of withdrawal, in accordance with this article, are the costs of transporting the Product to "47 Anno Domini". Products that are not returned according to the aforementioned methods will not be accepted by the Supplier and, as a result, will not be reimbursed. It is understood that in case of right of withdrawal, the Supplier is not responsible for the theft or loss of the Products occurred during the transport of the goods to the Supplier. In case of exercise of the right of withdrawal by the Customer, the Supplier will refund the price of the Product, within 14 days of receipt of the notice of withdrawal provided that within that period the goods have been returned in the conditions and with the methods indicated in this article. Competent Court and Applicable Law
Pursuant to art. 63 of Legislative Decree 6 September 2005, n. 206, all disputes concerning the validity, interpretation, execution, effectiveness of this Contract will be devolved to the jurisdiction of the Court of the place of residence or domicile of the Customer. This contract is regulated by the Italian law.

Effectiveness of the Contract
The confirmation of the purchase order of the Products / Services implies, for the Customer, the acceptance of these general terms and conditions. These general terms and conditions may be updated and / or modified unilaterally by the Supplier and will be valid from the date of publication on the Website.
